Terms of Service

1. Acceptance of Terms

By accessing or using Adkeet ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age to use Adkeet. We do not knowingly collect data from anyone under 13. If you are between 13 and 18, you may not use the Service. By creating an account, you represent and warrant that you meet this age requirement.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity under your account. Notify us immediately of any unauthorized use. We are not liable for losses caused by unauthorized account access.

4. Credit System

  • Credits are received through a subscription and are used to generate AI content. While your account is on a paid plan you can also top up with one-off credit packs; credit packs are not available to accounts on the free plan.
  • Credits are non-transferable and have no cash value.
  • Monthly plans: your plan's monthly credit allowance is added to your balance each time a monthly payment succeeds.
  • Yearly plans: the price is paid once for a 12-month term, and the credits are paid out monthly, not all at once. Each month of the term you receive your plan's monthly allowance: the first month when the yearly payment succeeds, then one month at a time until the 12th. Each renewal starts a new 12-month term. If the payment for a term is refunded in full, the monthly credits not yet paid out for that term are not granted. While a dispute (chargeback) over that payment is open, or if the dispute is decided against us, those monthly credits are withheld; if the dispute is resolved in our favour, they resume, including any months held back while it was open.
  • Unused credits roll over. Credits in your balance, whether from a subscription or a credit pack, are not reset when a new month or billing period starts and do not expire while your account exists. They stay yours if you change plan or cancel. They are removed when your account is deleted.
  • When credits run out, you cannot generate content until you receive your next monthly allowance or, on a paid plan, buy a credit pack.

5. AI-Generated Content

  • All outputs produced by Adkeet are AI-generated.
  • There is no guarantee of accuracy, quality, ad performance, or approval by any advertising platform (including Meta, TikTok, YouTube, or Google).
  • You must review all outputs before publishing or distributing.
  • We make no guarantee that outputs are free of intellectual property, trademark, or likeness issues.

6. Intellectual Property

Subject to the terms of our AI providers, you retain ownership of outputs you generate. However:

  • Adkeet may store and process your content to operate and improve the Service.
  • Our AI providers (including Atlas Cloud) have their own commercial-use terms. We do not promise more ownership rights than those providers allow.
  • You must own or have appropriate rights to all assets you upload.

7. Prohibited Conduct

Use of Adkeet is subject to our Acceptable Use Policy. Violations may result in account suspension or termination without refund.

8. Payment Terms

  • Prices are displayed in USD at the time of purchase.
  • Subscriptions are billed monthly or yearly, as you choose at checkout. Each period is paid in advance, and the subscription renews automatically for the same period unless cancelled.
  • An account can hold one subscription at a time. To change plan, use the plan options in your account rather than buying a second subscription.

Changing plan

  • Upgrading (a larger plan with the same billing period) takes effect immediately. We charge you straight away for the price difference over the rest of your current billing period, in proportion to the time left. If that payment fails, your plan does not change. Once it succeeds, you immediately receive the extra credits for the rest of the current month, in proportion to the time left in that month (for a yearly plan, the current monthly credit period). From the next month you receive the new plan's full monthly allowance.
  • Downgrading a monthly plan (a smaller plan) takes effect immediately, with no refund and no charge for the current period. Credits you have already received are kept. The lower price and the smaller monthly allowance apply from your next billing date.
  • Downgrading a yearly plan is not possible during its 12-month term. To move to a smaller plan, cancel the yearly plan, which stays active until the end of the term, and choose the smaller plan once it has ended.
  • Switching between monthly and yearly billing starts a new billing period on the day you switch. The new plan's price is charged immediately, minus a credit for the unused part of your current period. Only if that credit is larger than the new price is the rest kept as a balance with our payment processor, Stripe, where it is used towards your future subscription payments. That balance is never paid back to your card. If the payment fails, nothing changes. Once it succeeds, you immediately receive the first month's credit allowance of the new plan. You can switch between monthly and yearly billing at most once every 30 days.
  • A plan cannot be changed while a subscription payment is overdue. Update your payment method first. You can still cancel.
  • Choosing a plan while a cancellation is pending withdraws the cancellation, and the subscription continues to renew.

Cancelling

  • You may cancel at any time. Your subscription then ends at the end of the billing period you have already paid for (for a yearly plan, the end of the 12-month term). Until then you keep your plan, including, for a yearly plan, the remaining monthly credit payouts of that term.
  • If a subscription payment is overdue when you cancel, the subscription ends immediately.
  • When you cancel a monthly plan and tell us the price is the reason, we may suggest a smaller monthly plan instead. Taking it is optional. If you do, the rules above for downgrading a monthly plan apply: the change takes effect immediately, nothing is charged that day, the credits you already have are kept, and the lower price and smaller monthly allowance apply from your next billing date. Your subscription then continues on the smaller plan, and any pending cancellation is withdrawn. Discounts accepted before October 18, 2026 continue on their original terms.
  • Deleting your account cancels any subscription immediately.
  • We reserve the right to change pricing with 30 days' notice.

9. Refund Policy

Refunds are subject to our Refund Policy. In summary: a 7-day goodwill window worldwide, unused credits only, abuse exceptions apply — and, for consumers in the EU, the EEA and the UK, a statutory 14-day right of withdrawal that sits above that policy and is not reduced by it.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUTS WILL MEET YOUR REQUIREMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADKEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or our Acceptable Use Policy. Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law.

13. Governing Law

These Terms are governed by the laws of the Province of Québec, Canada, without regard to its conflict-of-law rules. Any dispute shall be brought in the courts of that jurisdiction.

If you are a consumer, nothing in this section deprives you of the protections of any mandatory law of your country of residence, and you may bring proceedings in the courts of that country. For consumers in the EU, the EEA and the UK that expressly includes the right of withdrawal described in our Refund Policy.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.
